Pedestrian Killed, Justine Rivas Arrested in DUI Crash on Highway 101 [San Jose, CA]

Elderly Man Dies after Struck by DUI Driver on Highway 101 near McKee Road

 
SAN JOSE, CA (March 20, 2024) – A pedestrian was killed in a DUI crash on Highway 101 in San Jose Tuesday evening on March 19.
 
The fatal crash happened around 9:15 p.m., just north of McKee Road. According to the California Highway Patrol, 25-year-old Justine Rivas of San Jose was driving a 2011 Toyota Camry north on Highway 101 when she struck the pedestrian.
 
The victim, an elderly man, was pronounced dead at the scene. His identity was not immediately available.
 
Officers said Rivas was driving under the influence of drugs or alcohol at the time of the crash. They arrested and booked her into the Santa Clara County jail on $175,00 bail.
 
When Rivas allegedly hit the man, there was also a 3-year-old boy in the car with her, the CHP said.
 
An investigation into this fatality is ongoing.
